1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of epidemic.gg (the “Site”). By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (the “Privacy Policy”). If you do not agree to these Terms, you must not access or use the Site.

2. Changes to These Terms

We may update or modify these Terms at any time in our sole discretion. Any changes will become effective immediately upon posting on the Site. We may also update the “Effective Date” at the top of these Terms. Your continued use of the Site after any changes are posted constitutes your acceptance of the updated Terms.

3. Eligibility

You must be at least 13 years old to use the Site. If you are under the age of majority in your jurisdiction, you may use the Site only with the consent and supervision of a parent or legal guardian.

4. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You are solely responsible for your conduct while using the Site and for ensuring that your use does not violate any applicable law, regulation, or the rights of any third party.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal or internal business use. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any Content without our prior written permission, except as permitted by law.

7. User Content

If the Site allows you to submit, upload, post, or otherwise make available content (including text, images, links, or other materials) (“User Content”), you retain ownership of your User Content. By submitting User Content, you grant epidemic.gg a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for formatting/display), publicly display, and distribute such User Content in connection with operating, improving, and promoting the Site. You represent and warrant that you have all rights needed to submit the User Content and that it does not violate any law or infringe any third-party rights.

8. Prohibited Conduct

You agree not to: - Use the Site in any way that could disable, damage, overburden, or impair the Site or interfere with any other party’s use. - Attempt to gain unauthorized access to the Site, accounts, servers, or networks connected to the Site. - Use bots, scrapers, crawlers, automation tools, or other automated means to access, monitor, or copy content from the Site without express written permission. - Reverse engineer, decompile, disassemble, or attempt to derive source code from the Site, except where prohibited by law. - Use the Site for any illegal, harmful, fraudulent, abusive, or harassing purpose. - Circumvent any security features or access controls.

11. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to the Site, us, or other users. Sections intended to survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Governing Law) will survive.

12. Disclaimer of Warranties

THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EPIDEMIC.GG, ITS OWNERS, AFFILIATES, EMPLOYEES, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US (IF ANY) IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify, defend, and hold harmless epidemic.gg and its owners, affiliates, officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your access to or use of the Site, (b) your User Content, or (c) your violation of these Terms or applicable law.

15. Dispute Resolution; Arbitration (Optional Clause)

Except where prohibited by law, any dispute arising out of or relating to these Terms or the Site will be resolved exclusively through binding arbitration on an individual basis, and not in a class, consolidated, or representative action. If you would like this clause removed, contact us.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
