These Terms of Service (“Terms”) govern your access to and use of epidemic.gg (the “Site”). By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (the “Privacy Policy”). If you do not agree to these Terms, you must not access or use the Site.

We may update or modify these Terms at any time in our sole discretion. Any changes will become effective immediately upon posting on the Site. We may also update the “Effective Date” at the top of these Terms. Your continued use of the Site after any changes are posted constitutes your acceptance of the updated Terms.

By submitting User Content, you grant epidemic.gg a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for formatting/display), publicly display, and distribute such User Content in connection with operating, improving, and promoting the Site. You represent and warrant that you have all rights needed to submit the User Content and that it does not violate any law or infringe any third-party rights.

You agree not to: - Use the Site in any way that could disable, damage, overburden, or impair the Site or interfere with any other party’s use. - Attempt to gain unauthorized access to the Site, accounts, servers, or networks connected to the Site. - Use bots, scrapers, crawlers, automation tools, or other automated means to access, monitor, or copy content from the Site without express written permission. - Reverse engineer, decompile, disassemble, or attempt to derive source code from the Site, except where prohibited by law. - Use the Site for any illegal, harmful, fraudulent, abusive, or harassing purpose. - Circumvent any security features or access controls.

The Site may reference or link to third-party websites, services, or resources. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to those third-party terms.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EPIDEMIC.GG, ITS OWNERS, AFFILIATES, EMPLOYEES, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US (IF ANY) IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless epidemic.gg and its owners, affiliates, officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your access to or use of the Site, (b) your User Content, or (c) your violation of these Terms or applicable law.

Except where prohibited by law, any dispute arising out of or relating to these Terms or the Site will be resolved exclusively through binding arbitration on an individual basis, and not in a class, consolidated, or representative action. If you would like this clause removed, contact us.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
